State Supreme Court Justice John F. O’Donnell dismissed Ryan’s petition, finding no evidence that Mascia committed fraud.
Ryan had attempted to invalidate the designating petitions filed by Joseph A. Mascia, who recently won election to his fourth term on the Buffalo Municipal Housing Authority’s board of commissioners.
Saying he found no evidence that Mascia committed fraud, O’Donnell dismissed Ryan’s petition.
Sean E. Cooney, Ryan’s lawyer, filed an appeal with the State Appellate Court on Wednesday.
Ryan, Mascia and Kevin P. Gaughan are on the Democratic primary ballot for the state Assembly’s 149th District covering parts of Buffalo, Lackawanna and Hamburg.
