Eva Hassett from Savarino Construction reports to Buffalo Rising that the hotel project is dead, due to age-old deed restrictions affecting the Mobius properties in question.

Commenters there immediately called Savarino out for its “BS” excuse for killing the project. Quite the contrary, as I point out in my comment there,

Certainly, Savarino could have gone to trial and argued that the neighborhood has changed significantly since the restrictions came into place, but oftentimes people don’t enjoy buying their property with a side order of litigation.

It’s sad that the hotel isn’t going to happen. But it’s not every day that a blog post prompts discussions about the rule against perpe-fricking-tuities (which, incidentally, is not applicable to a deed restriction, since there’s no issue of a contingent future deed transfer).
