
The Daily Gotham revealed the other day that Jack Davis has set up a fake version of Jon Powers’ website, mimicking almost exactly its layout, design, photographs, and logos. The Daily Gotham likens the whole thing to phishing scam sites that are made to look like PayPal, but actually are used to steal your identity. Here, from top to bottom, is a screenshot of Powers’ actual site, and below it is a shot from Davis’ scam site.


And indeed, it so closely resembles Powers’ real website, and uses a URL (which I’m not going to post or link to) that would lead a casual observer to believe, mistakenly, that it was a Powers-sanctioned site. Only the “Paid for by Davis for Congress” in what appears to be 6 point type at the bottom of the page reveals its true author.
First off, it’s not a parody site because it’s not funny. Seconly, it’s not protected by the fair use doctrine because it’s not using mere excerpts of Powers’ work product, but has completely mimicked his site in an effort to confuse and trick the reader. Everything right down to the logo, the font, the layout, and even the portrait, originally shot by Clarence photographer Chuck Eckert.
All of these items are protected by automatic copyright held by Mr. Powers. We all expected Jack Davis to use his millions to smear Powers. None of us expected him to do it by breaking the law and deliberately tricking prospective voters.
Instead, let’s focus on the real Jack Davis. The Jack Davis who says he’ll go to congress to battle the Democrats. The Jack Davis who is so anti-immigrant (really, anti-foreigner), he’s willing to completely disregard the needs of local farmers in his own district. The Jack Davis who ran in 2004 and lost. The Jack Davis who ran against a politically mortally wounded Tom Reynolds and lost. The Jack Davis who said in 2006 that he was “relieved” not to be going to Washington.
Oh, and the fact that Jack Davis is about as much a Democrat as Pat Buchanan. Davis just crossed a line from campaigning to outright fraud.

davis lost narrowly last time because “progressive’ outlets such as this deemed it better to have a wounded republican asshole in office for another two years than to have someone of their own party who they didn’t like. i’ve never understood that mentality, but it seems to be the prevailing one in today’s democratic party.
if — horrors! — the general election does get down to davis v. powers, who would you support?

I actually agree with you, which is weird. I’d rather have 218 Democrats I hate than 218 Republicans any day, because at least those Democrats aren’t actively hurting America like the Republicans have seemed want to do since about 1997.
This constant questioning of the legality of every move Jack Davis makes is getting real old, especially since you haven’t been correct one time. Not a good record for an attorney.
I’ll agree that this move by Davis is slimy, but it’s not unprecedented.

Jack Davis is subjecting the entire district to an old man’s psycho-drama. He’s never been running FOR Congress, it’s been always AGAINST someone. The last two cycles, he was running against Reynolds (and Cheney). This time, he isn’t running to represent our district, he’s running AGAINST the young whippersnapper who dared to run for the seat Jack thinks he’s bought and paid for. Too bad that young whippersnapper is actually running for Congress the right way and gaining the support of Democrats at every level throughout the district.

If by shill you mean someone who has examined the issues and people involved, made my choice, and put my time, effort, and money where my mouth is, I guess you’re right. Do you make phone calls for your candidate? Do you knock on doors? Oh, that’s right. Jack isn’t interested in voter contact. Jack doesn’t have volunteers. Jack just buys what he wants, so I guess that leaves you out of the loop. Unless you’re a paid shill, because he doesn’t have any other kind.

It would appear to me that the Democratic Party has hurt the American people more in 2 years than the Republicans have in your alleged last 11.
I’m waiting for Speaker Pelosi’s gas price reduction to go into effect, so the blue collar working people she’s SUPPOSED to be representing don’t have to worry about how they’re going to get enough fuel to go to work.
As for this “Shorter Powers Website”, Pundit has done the same parody to MKG and others many times, sometimes funny–sometimes not so.
I think it’s funny. But then again I ALWAYS enjoy watching 2 Democrats tear at each other like 2 cats in a gunny sack.
Mike, oddly enough, we (WNYM, not just Alan) were Davis supporters in the last two election cycles…albeit tepid ones.
We shot some pretty infamous video of a Tom Reynolds press conference which made the rounds on national newscasts and we were generally supportive of Jack.
After he failed to win an election that was handed to him on a silver platter and admitted that he was thankful to not be in Congress and saying he wouldn’t run again, I think most of us had moved on.
If the election were Davis vs. Lee, I’d vote Lee. However, I don’t live in the district.

As a conservative you should oppose offshore oil drilling and ANWR exploration – not on principal, like the environmental extremists, but out of national security concerns.
Look, the last country with oil wins. Period. We desperately need to be that country, or we’re going to end up at the mercy of whatever dictator manages their oil policy better than us.
@Pessimist, How easily you forget that your young whippersnapper began his campaign solely running AGAINST Tom Reynolds. It wasn’t until Reynolds exited the race and there was no one specifically running other than Jonny for a few months that he really started just running for Congress. Even now, as evidenced here and other places, he has plenty of surrogates running him AGAINST Davis and Lee rather than solely for Congress. I have heard much more against Davis and Lee than I have heard about Jonny and his plans. The usual response to that is, “look at his website for yourself.” Even Jonny’s own press releases are still laden with attacks and statements AGAINST his opponents, not just about him running for Congress.
I’m not exactly sure what the “right way” is to run for Congress, but in a district like this, it’s certainly not to just gain the support of Democrats.
Russell… can you post Chris Lee’s views on foreign policy, ideas for lowering our dependence on foreign oil, beliefs about the war in Iraq, how about the economy and creating jobs? I’m not asking for written legislation, just something documented other than his websites “wny economy is bad” comments. He has no plans for jobs/housing/etc… but I guess Reynolds hasn’t given him his folder with his opinions in it yet.
We could list Davis’ last speech in Batavia about his immigration plan (cited before as building 2 giant walls along Mexico because they’re trying to steal our southern states) to the farmers in the rural districts who said they depend on the immigrants to keep food on our table cheaply and make a living. So his solution costs us billions in government contracts and also triples the cost of food for the people of WNY.
Or will he just “move his millions” from big oil to a “holding” company like he tried to promise in the press so he could vote down gas prices.
If you check on Mr. Powers’ press releases found on the real website, most seem to be references and comment made about attacks already made on him.
There is also a difference between saying “he’s not a good candidate” or “he owns a lot of oil stock” in the local papers and creating a completely fake website to run a smear campaign
Mr. Davis also proved he is a “flip flopper” as he promised in his campaign speech to run a clean campaign to avoid “dirty politics” and yet that is the only thing his campaign manager seems to be pushing.
Davis can send the mailers that highlight his “good qualities”, but if it wasn’t enough that people didn’t like him already – this negative campaigning is going to lose this for him for sure.

chris…my memory of the davis/reynolds race on this site is somewhat different, but i’ll take you at your word. i don’t, however, believe that the anti-reynolds stuff was necessarily pro-davis, however.
and shill, i mean pessimist, i don’t have a candidate in the race. my representative in congress is the great louise slaughter. i do know that i’ve met jack davis and seen even more of his television advertising, met with chris lee a couple of weeks ago and he seemed young and energetic and prosperous and goodlooking, but the only place i ever hear about powers is on this web site, which is relentlessly negative about both lee and davis, playing “gotcha” about silly things like copying a web site or the fact that they have more money than the apparently impoverished but i’m sure quite admirable mr. powers.
and smiles, as for powers’ “views” vis a vis foreign policy, foreign oil, the war, the economy and job creation, i don’t even have to ask. they are the same as nancy pelosi’s. if they weren’t, he wouldn’t be getting such a large chunk of his funding from outside the district and, indeed, from outside the state.

1.NY has one of the larger delegations in the House due to population, but it’s getting smaller thanks to the State and local governments causing migration of tens of thousands of residents every year to states that use a bit more sense in governing.
2. You’re correct in that a freshman rep from Spitzer’s Appalachia is going to be as important and lasting as a fart in a high breeze, regardless of party.
3.Her Excellency the Speaker tells these newbies exactly what Dolph Lundgren said to Rocky Balboa “I WILL BURY YOU”–if you don’t step and fetch as she directs.
Actually, regardless if Davis OR Powers wins, they’ll be pretty ineffective. No contacts, no seniority, nothing to put on the table. But it will make all the lefties feel better that Reynolds isn’t in there. Instead of a Republican they disliked heartily that had juice to get things done, they’ll have their beloved Democrat that will be the piece of dog shit under Pelosi’s shoe.

There’s no need to malign Pat Buchanan in this post, he’s made much more sense than just about any other politician. Probably because he’s not running for anything and doesn’t have to shovel the BS that Powers and others use to pander to the populace.
Pat Buchanan’s anti-semitism pretty much negates any “sense” he might otherwise make.
