DISTRICT ATTORNEY MOVES TO VACATE WARRANTS FOR LOW-LEVEL MARIJUANA ARRESTS

Today, Erie County District Attorney John J. Flynn moved to vacate outstanding warrants stemming from the failure to appear in Buffalo City Court on violation and misdemeanor marijuana possession cases. This action effectively cleared the entire docket of warrants for low-level marijuana arrests in Buffalo City Court.

District Attorney Flynn appeared before Buffalo City Court Judge Thomas P. Amodeo to vacate the warrants and dismiss the associated charges for 35 individuals who were charged with smoking or possessing marijuana. Judge Amodeo granted the DA’s oral application to vacate the warrants and dismiss the associated charges.

Starting in early January 2019, the Erie County District Attorney’s Office searched for active warrants in Buffalo City Court where the sole charge was a low-level possession marijuana offense. With the assistance of the Office of Court Administration and the Buffalo City Court Clerk’s Office, it was determined that there were 35 warrants issued between April 2009 and October 2018. The charges included Criminal Possession of Marijuana in the Fourth Degree, a Class “A” misdemeanor, Criminal Possession of Marijuana in the Fifth Degree, a Class “B” misdemeanor, and Unlawful Possession of Marijuana, a violation.

At the 2019 State of the City address, Mayor Byron Brown announced that he ordered the Buffalo Police Department to stop the enforcement of low-level marijuana offenses. Accordingly and in the interest of justice, DA Flynn sought to vacate these warrants and dismiss charges against those arrested for violation and misdemeanor marijuana charges.

DA Flynn plans to dismiss similar warrants throughout Erie County. He has directed his office to gather warrant data from the town courts where individuals have been charged only with violation or misdemeanor marijuana possession.

Governor Cuomo has declared the legalization of marijuana a legislative priority this year. It is still being discussed in Albany whether the legislation will include directives on vacating past marijuana convictions. Once a state law on recreational marijuana has been signed by the Governor, DA Flynn will determine how to proceed in vacating low-level marijuana convictions.

“As legalization discussions continue in Albany, I am relieving a burden on those individuals who may have these charges hanging over their heads in the interest of justice,” said Erie County District Attorney John J. Flynn. “I do not believe people should find themselves in the criminal justice system and unable to apply for employment, student loans, or other services because of a low-level marijuana charge.”

Trump Cabinet secretaries race to put out statements supporting Susie Wiles



Almost all of President Donald Trump's Cabinet secretaries quickly released statements supporting White House Chief of Staff Susie Wiles after she criticized them in an interview with Vanity Fair.

"The article published early this morning is a disingenuously framed hit piece on me and the finest President, White House staff, and Cabinet in history," Wiles wrote Tuesday on X. "None of this will stop our relentless pursuit of Making America Great Again!"

Many of the Cabinet secretaries quoted Wiles in responding.

"Susie is an exceptional Chief of Staff, and her tireless dedication, loyalty, and commitment to the President are beyond reproach. Powerful leadership often works quietly – never seeking credit and always relentlessly driving results. Our Chief exemplifies that," Treasury Secretary Scott Bessent wrote. "Our Administration is united under the leadership of President Trump, and Susie's extraordinary attention to detail, diligence, and dedication to our cause is at the center of our efforts."

"These inflammatory and outright false statements will not be tolerated," Energy Secretary Chris Wright agreed. "Susie Wiles isn't just an extraordinary strategist… she's sharp, authentic, and steady under pressure. She is one of the most competent, principled, and courageous leaders I have ever worked with, and I am honored to stand alongside her every day."

Labor Secretary Lori Chavez-DeRemer called Wiles "a great friend, mentor, and the architect behind President Trump's successful first months in office."

Education Secretary Linda McMahon insisted that Wiles was "a force of nature - the shrewdest and most loyal Chief of Staff."

Housing and Urban Development Secretary Scott Turner, Interior Secretary Doug Burgum, Agriculture Secretary Brooke Rollins, Transportation Secretary Sean Duffy, and FBI Director Kash Patel also expressed support.

"The radical left is at it again, trying to create discord on President Trump's team. It won't work because we know & love @SusieWiles," Duffy wrote.
