Gunman charged in Tops mass shooting pleads guilty

BROOME COUNTY TEEN PLEADS GUILTY FOR KILLING TEN VICTIMS AND ATTEMPTING TO KILL THREE OTHERS IN RACIALLY-MOTIVATED RAMPAGE SHOOTING AT BUFFALO GROCERY STORE

The defendant is the first person to be indicted and convicted under New York State Penal Law 490.28 “Domestic Act of Terrorism Motivated by Hate in the First Degree” for the intentional murder of ten innocent people and the attempted murder of three survivors who were shot in a planned attack against African American civilians on May 14, 2022

Erie County District Attorney John J. Flynn announces that 19-year-old Payton S. Gendron of Conklin, New York pleaded guilty this morning before Erie County Court Judge Susan Eagan to the highest charges in the indictment against him. Today, Gendron pleaded guilty, as charged, to the following offenses:

  • One count of Domestic Act of Terrorism Motivated by Hate in the First Degree (Class “A-I” felony)
  • Ten counts of Murder in the First Degree (Class “A-I” felonies)
  • Three counts of Attempted Murder in the Second Degree as a Hate Crime (Class “A-I” felonies)
  • One count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony)

On Saturday, May 14, 2022, at approximately 2:30 p.m., the defendant, with the intent to cause the death or attempt to cause the death of five or more people based on the race or perceived race of such persons, drove to Tops Friendly Markets on Jefferson Avenue in the City of Buffalo to commit a mass shooting.

The defendant, who was wearing tactical gear and armed with an assault weapon, encountered several people in the parking lot. The defendant intentionally shot four people outside of the grocery store. Three of the victims died from their injuries. The fourth victim was injured by gunfire, but survived.

After the initial shooting, the defendant immediately entered the store. The defendant exchanged gunfire with an armed security guard who attempted to stop the attack. The security guard was fatally injured and died at the scene. While inside of the store, the defendant intentionally shot eight more people. Six victims died from their injuries. Two victims were injured by gunfire, but survived.

The defendant was quickly apprehended by Buffalo Police officers who responded to the scene within two minutes of the initial 911 call. The defendant taken into custody without further incident.

Gendron faces maximum of life in prison without the possibility of parole when he is sentenced on Wednesday, February 15, 2023 at 9:30 a.m. He continues to be held without bail at the Erie County Holding Center.

“After selecting the City of Buffalo as the target of his planned terror attack, this defendant drove for several hours with the intent to kill innocent African American citizens as they shopped for groceries on a Saturday afternoon. Violence, especially violence motivated by hate or prejudice, will not be tolerated. I, along with the four Assistant District Attorneys who have diligently worked on this case, remain committed to obtaining justice for the victims and this community by prosecuting this defendant to the fullest extent of the law. I continue to pray for all who have been impacted by this tragedy. While we may never fully heal from the horrific crime and the loss of life that occurred on May 14th, I hope that the families of the victims and the survivors feel that justice has been served by this defendant pleading guilty today. Our office will request that the Court impose the maximum sentence,” said Erie County District Attorney John J. Flynn.

District Attorney Flynn commends the Buffalo Police Department their work in this investigation with a special acknowledgement to Lieutenant Patrick McDonald and Officers Ann Devaney, Anthony D’Agostino and Christina Ihle who arrived first at the scene of this horrific crime. DA Flynn also commends the Erie County Sheriff’s Office, New York State Police, Federal Bureau of Investigation, Bureau of Alcohol, Tobacco, Firearms and Explosives and all of the other assisting local, state and federal law enforcement agencies for their work in this extensive investigation.

DA Flynn recognizes the work of our office’s Homicide/Victim Witness Protection Case Manager Kimberly Rapp for providing ongoing support to the families of the ten victims and the three survivors throughout the prosecution of this case. DA Flynn also commends Chief Danielle D’Abate of the Community Prosecution/Training Unit for her work in community initiatives following this tragedy.

DA Flynn also acknowledges the numerous government agencies, community organizations and volunteers who have helped the people in our community who were impacted by this tragedy and the temporary closure of Tops Friendly Markets.

The case was prosecuted by Chief Gary W. Hackbush of the Homicide Unit, Chief John P. Feroleto of the Major Crimes Unit, Assistant District Attorney Justin H. Caldwell of the Narcotics/Intelligence Unit, Assistant District Attorney Noha A. Elnakib of the Special Victims/Domestic Violence Bureau and Assistant District Attorney Ryan D. Haggerty of the Homicide Unit.

‘Republicans’ worst nightmare’: Analyst warns ‘drunk with power’ GOP it’s made a stumble



An analyst warns Thursday that GOP lawmakers "drunk with power" have made a major stumble amid the ongoing government shutdown, unleashing "Republicans' worst nightmare."

Salon columnist Heather Digby Parton writes about how Obamacare premiums are set to soar — something President Donald Trump had promised to replace — and now "appears to be one step too far" for Americans.

"Ten years of similar promises have shown that replacing the Affordable Care Act wasn’t so easy after all — and that the only health care plan the GOP ever truly wanted was one called 'you’re on your own,'" Digby Parton writes.

Republicans haven't introduced any alternatives, instead people are receiving notices that their healthcare premiums are set to rise, while they cut Medicaid and close a number of rural hospitals, add work requirements and deny care to millions. And although they've pointed to Project 2025, aiming to force people into a privatized version of Medicaid and "plan to open up the market to sell junk insurance plans which are worth virtually nothing," it's still a half-baked policy, the writer argues.

"But the GOP’s lack of strategy and success makes it clear the party is as flummoxed on this issue as they’ve always been, and they know it’s a loser for them," she writes.

Healthcare matters for Americans because it's something that effects their daily lives, she adds, and "it’s now on the front lines of this massive war against our social safety net."

As the Trump administration works to defund scientific research and following "the government's shambolic response during the first year of the pandemic and the damage being done every day by the administration to our scientific research community, I suspect a lot of people are feeling insecure about their actual health care these days."

That could leave room for Democrats to step in and hold the line.

"If Democrats can find the fortitude to hold out for their demands, they will have taken the first step in reining in this lawless administration and given the American people something to hold onto in these dark days," Digby Parton writes.

Top GOP leader bemoans Dems are ‘holding government funding hostage’



A high-ranking Republican is blaming Democrats over a looming government shutdown.

Senate Majority Leader John Thune (R-SD) penned an opinion piece for The Washington Post on Monday, claiming that leaders must avert a spending crisis with a bipartisan appropriations process and claiming "Democrats are holding government funding hostage to a long list of partisan demands, totaling more than $1 trillion. And they’re ready to shut down the government if Republicans don’t comply."

Thune was among a group of leaders slated to meet Monday with President Donald Trump in the Oval Office, which includes House Minority Leader Hakeem Jeffries (D-NY), Senate Minority Leader Chuck Schumer (D-NY), and House Speaker Mike Johnson (R-LA).

This closed-door meeting is just hours before the Oct. 1 deadline. A White House official described this as a make-or-break moment. It's also the first time Trump will meet with the Democratic leaders since he took office eight months ago.

Thune argues that "Republicans are open to discussion and negotiation on a number of issues."

"But there’s a difference between careful discussion and negotiation during the appropriations process and taking government funding hostage to jam more than $1 trillion in big-government spending in a funding bill designed to last mere weeks," Thune writes. "Major decisions should not be made in haste. And they certainly shouldn’t be made because one party is threatening to shut down the government if it doesn’t get its way."

As Republicans urge Democrats to accept the bill, Democratic leaders have pushed back against cuts to healthcare.

Affordable Care Act subsidies are set to expire this year. And without an extension, the Congressional Budget Office estimates that more than 4 million people will lose healthcare over the next 10 years.

Thune claims that "Democrats have decided to abandon the process."
