Off-Track Betting in Western New York is off track

With local politics beginning to focus particularly on the upcoming races for Erie County Executive and the Buffalo Common Council some public issues have fallen off the radar screen.  That’s unfortunate because there are subjects that deserve more attention.  For example, OTB.

The Western New York Off-Track Betting Corporation (WROTBC) has been in existence for approximately fifty years.  The original intentions were to put a crimp in illegal betting on horse races while also providing a new revenue source for the member governments of the WROTBC.  There are 15 counties participating along with the cities of Buffalo and Rochester.

Over the years the organization has operated many local betting parlors throughout the member counties.  The parlors were good for employment often related to political parties, but over time they became a financial drag on the organizations and led to diminished funding sent to member counties and cities.  Many parlors have been closed but all of the remaining parlors lose money. 

Over the years WROTC got into other gambling activities.  Online horse gambling became profitable.  The state allowed OTB organizations in the state to set up casinos of a sort, that offered some of the amenities of full-blown gambling operation (slot machines, restaurants, entertainment), but lacked table games provided in Native American-run casinos and others that the state has permitted.  WROTBC bought the Batavia Downs harness racing track, subsequently opening up the casino there. 

WROTBC authorized the private development of a hotel on the grounds of Batavia Downs, but more recently it was sold to the WROTBC.

Over time the operations of the system have attracted the scrutiny of various investigators including the state Comptroller and the FBI.  WROTBC has spent millions of dollars employing lawyers and lobbyists to deflect the investigations.  The state Gaming Commission has had little to say about the system.

Erie County Comptroller Kevin Hardwick is trying to shed light on what has been happening.  Mostly the leadership of WROTBC has dodged and weaved, offering up little information and trying their best to avoid being called to task.  On February 3, 2023 Hardwick sent a letter to the CEO of the organization, Henry Wojtaszek, and their Board Chairman, Richard Bianchi, seeking answers to previously posed but mostly ignored questions.  Among the issues the Comptroller raised were the following:

  • Details relating to WROTBC’s purchase of the hotel at Batavia Downs from the original developers, such as the valuation of the land that the hotel sat on and the sale price that substantially exceeded what the hotel cost the developers to build and furnish originally; looking for information on how the deal was financed.
  • The availability and cost of health, dental, and vision care provided to current and retired part-time Board members of the organization.  The state Attorney General issued an opinion in 2008 to another OTB organization advising that OTBs are not permitted to provide health insurance to board members.  For the past four years WROTBC has stalled and dodged on the question, claiming that one of their contracted attorneys was negotiating with the AG about the issue. The organization has failed to provide any information about those negotiations. 
  • Most publicly created corporations, authorities, and other public agencies in New York State provide no compensation to their board members.  WROTBC pays their directors $4,000 each per year.  The directors are also reimbursed for their expenses such as mileage.  Free stays at the hotel at Batavia Downs have been made available.
  • Since 2014 WROTBC has paid ten different Albany lobbyists more than $1.3 million in fees.  The results of the lobbying efforts have not been identified.
  • There has been reporting from time-to-time about how and why WROTBC manages the use of luxury boxes that they lease at Buffalo Bills and Buffalo Sabres games, as well as concerts and other public events.  Staff and board members have used the perks as well.  There has been no accounting about how such marketing activities are financially beneficial to the organization and its members.

Commenting on these issues, Comptroller Hardwick tells Politics and Other Stuff that “my office has been looking into a number of concerns at WROTB since summer 2022.  After we sent multiple letters and emails, WROTB hosted us at a meeting at Batavia Downs on October 5, 2022 and pledged to answer our questions and be transparent concerning their operations. 

“However, since that time, despite repeated emails and letters from me and my staff, and promises by WROTB’s chief executive officer to cooperate, WROTB has not provided full, or in some instances, any answers to our questions regarding their hotel, their health insurance for directors and retired directors, and their spending on outside lobbyists and attorneys.

“As chief financial and auditing officer of Erie County, and because Erie County is a co-owner of WROTB, I will continue to pursue accountability and transparency by WROTB’s management and board of directors.”

Going forward, the question that needs to be asked is, does the relatively limited funding distributed to member counties and cities justify the organization’s continued operations, at least in its present form?  New York City’s much larger Off-Track-Betting system was shut down 13 years ago.

State Senator Tim Kennedy and Assemblywoman Monica Wallace a couple years ago proposed legislation to clean up and re-organize the operations of WROTBC.  To date nothing has come of that legislation.  The lobbyists’ impact is felt, but it has been a negative impact preventing reforms from being imposed.  Reforms may also be stifled by whatever interests some of the member counties have in continuing things just as they are.

What we have with WROTBC is a 50-year-old institution that operates as it pleases, paying limited attention when poked, but otherwise ignoring those who have asked questions or conducted investigations. Public interest has taken second place to maintaining the status quo at an organization that has forgotten why it was created in the first place.

Republicans haven't introduced any alternatives, instead people are receiving notices that their healthcare premiums are set to rise, while they cut Medicaid and close a number of rural hospitals, add work requirements and deny care to millions. And although they've pointed to Project 2025, aiming to force people into a privatized version of Medicaid and "plan to open up the market to sell junk insurance plans which are worth virtually nothing," it's still a half-baked policy, the writer argues.

"But the GOP’s lack of strategy and success makes it clear the party is as flummoxed on this issue as they’ve always been, and they know it’s a loser for them," she writes.

Healthcare matters for Americans because it's something that effects their daily lives, she adds, and "it’s now on the front lines of this massive war against our social safety net."

As the Trump administration works to defund scientific research and following "the government's shambolic response during the first year of the pandemic and the damage being done every day by the administration to our scientific research community, I suspect a lot of people are feeling insecure about their actual health care these days."

That could leave room for Democrats to step in and hold the line.

"If Democrats can find the fortitude to hold out for their demands, they will have taken the first step in reining in this lawless administration and given the American people something to hold onto in these dark days," Digby Parton writes.

Trump’s blunders ‘raise the risk of global conflict’ as enemies ‘gang up’: analyst



After a series of diplomatic blunders, President Donald Trump and America's reputation loss could "raise the risk of global conflict" and come at a major cost, including "mischief or worse" from enemies.

In an opinion piece published Monday, Bloomberg columnist Andreas Kluth describes how a good reputation can be difficult to obtain or maintain, and Trump "has squandered whatever credibility America had left in foreign and security policy."

Following his rambling speech last week in front of the United Nations and his struggle to see the difference between "personal chemistry" with President Vladimir Putin and diplomatic action, Trump has effectively put both adversaries and allies on edge, wrote Kluth.

"Inklings of danger are everywhere," Kluth writes. "America’s partners are becoming more anxious and making alternative arrangements for their security: Saudi Arabia just signed a defensive pact with Pakistan after watching an Israeli strike against its Gulf neighbor Qatar, which is allied to, but got no help from, the United States. America’s adversaries keep testing the resolve of Trump and the West, as Putin is doing in eastern Europe. Or, like Xi Jinping in Beijing and Kim in Pyongyang, they’re recalculating bellicose scenarios in secret. Other countries, like India, are wary of committing to America and keeping all options open, even clutching hands with Moscow and Beijing."

And although Trump is not the first president to struggle with navigating U.S. reputation among foreign nations, it puts America at an unfortunate future disadvantage.

"Against this backdrop, anybody watching US policy for the past decade, from friendly Europe to adversarial China, already had reason to doubt US credibility. What Trump has done in his second term is to remove the doubts and confirm the loss. Allies now know they can’t trust America, while adversaries are ganging up and recalculating their plans for mischief or worse.

It's unclear what will happen in the future; a damaged reputation jeopardizes diplomacy.

"These responses to America’s loss of credibility will raise the risk of global conflict," Kluth writes. "The danger will go up even more if the US, under this or a future president, panics and decides to overcompensate in reestablishing its reputation, with a demonstratively hawkish turn that could tip into war. If America and the whole world are becoming less safe, it’s because Donald Trump’s foreign policy is, literally, in-credible."

‘Give them a taste’: GOP rep urges Trump to treat Dem leaders like Zelenskyy



U.S. Rep. Mark Alford (R-MO) called for President Donald Trump and his senior administration officials to treat House Democratic Leader Hakeem Jeffries and Senate Democratic Leader Chuck Schumer in the same manner they treated Volodymyr Zelenskyy earlier this year when they appeared to gang up on and berate the Ukrainian president.

Trump has not met with the Democratic leaders since he took office in January, and canceled a meeting with them slated for last week. They will be meeting in the Oval Office on Monday afternoon to discuss ways to avert a federal government shutdown at midnight on Tuesday.

Alford, a member of the far-right Republican Study Committee, told NewsNation on Monday, “Let’s give them a little taste of what we gave Zelenskyy back in the spring.”

Trump has falsely claimed that Democrats are “threatening” to shut down the government “unless they can have over $1 Trillion Dollars in new spending to continue free healthcare for Illegal Aliens.”

He, also wrongly, has claimed Democrats want to “force Taxpayers to fund Transgender surgery for minors, have dead people on the Medicaid roles, allow Illegal Alien Criminals to steal Billions of Dollars in American Taxpayer Benefits, try to force our Country to again open our Borders to Criminals and to the World, allow men to play in women’s sports, and essentially create Transgender operations for everybody.”

Alford echoed some of those allegations in his Monday remarks.

“So, this is what they wanted, all this crazy spending, going back to the woke policies and giving illegal aliens health care. Trump said, ‘There’s no way, why should I meet with them?'” Alford said.

“I think, over the last couple of days, he’s rethought that. Let’s bring them into the Oval Office. Let’s give them a little taste of what we gave Zelenskyy back in the spring,” the Missouri Republican declared.

“This is going to be live viewing, I believe, in the Oval Office,” Alford said, “like you’ve never seen before, maybe an hour-long meeting, and the American people can see for themselves the ridiculous request and demands as the Democrats hold them hostage.”

Jeffries on Monday told reporters, “We’re headed into the meeting [with Trump] to have a good faith negotiation about landing the plane in a way that avoids a government shutdown but does not continue the Republican assault on the healthcare of the American people.”

Democrats are “using one of their few points of leverage to demand Congress take up legislation to extend health care benefits,” PBS News reported. “Trump has shown little interest in entertaining Democrats’ demands on health care, even as he agreed to hold a sit-down meeting Monday with Schumer, along with Senate Majority Leader John Thune, House Speaker Mike Johnson and House Democratic leader Hakeem Jeffries. The Republican president has said repeatedly he fully expects the government to enter a shutdown this week.”
