Harding Arraigned and Charged in 2 Count Federal Complaint

Pete Harding has officially been charged with two counts – including violent entry or disorderly conduct on Capitol grounds. If found guilty he could be subject to up to 1 1/2 years in prison and heavy fines.
Harding will be released under heavy electronic monitoring protocols prior to further court proceedings.
His next court proceeding will take place next Tuesday, January 19, at 1 pm.

Magistrate Judge Jeremiah McCarthy is presiding. 

Criminal complaint against Harding is from DC District Court dated 1/11/21. 

Harding is charged in a 2 count complaint from DC District – violating 18 usc 1752 (a)(1) and (a)(2) unlawfully being on federal grounds. 

Second count is Title 40 USC 5104(e)(2)(c) violent entry and disorderly conduct on Capitol grounds. Max for both is 1.5 years and a fine. 

Harding is represented by Jason DiPasquale and Jeremy Schwartz. He will be pleading not guilty. 

Probation has 10 conditions of release recommended, and the Government consents to those. Harding’s counsel objects to some of it because he contacted the FBI on his own and these are misdemeanors. 

The Defendant left his house on 1/12 after his face was shown on the wanted poster and stayed with a friend. They are not asking for detention, but because he absented himself at that time, the govt believes monitoring is necessary. 

The Defendant was in the Capitol on 1/6 to interfere with government, and he may do this again. He posted to Facebook things that expressed a desire to do it again. “We learned how strong our numbers are if we can take the Capitol there is nothing we can’t accomplish.” 

Given Harding’s desire to promote and engage in similar future conduct and disruptions to constitutional process, monitoring is reasonably necessary. 

The government had to go looking for Harding after the FBI posted his picture, and this justifies monitoring per the govt. DiPasquale notes he was still in WNY and he did not flee when he learned of imminent charges. He cooperated with the FBI at arrest. 

He owns a house in OP and Cheektowaga and has ties to the community. He is a lifelong resident of WNY. He has an adult daughter in the area and poses no flight risk. He has no prior history of rioting. 

There are no allegations in the affidavit that he engaged in any destructive behavior while in the Capitol. 

His intention was to protest peacefully and that he was non-violent while in the Capitol. Harding is self-employed in construction. Harding raises his hand to say something. 

His lawyer tells him to be quiet. Judge rules: Electronic monitoring is reasonable. Mr. Harding is to travel only within WDNY and to the DC District but only for those court proceedings. 

The judge adopts all of the probation recommendations. He must remain at a verifiable address, stay in WDNY, only travel to DC for court, no firearms allowed, avoid contact w potential witness/victim, abide by conditions of location monitoring program, has curfew, and will pay. 

He must not tamper with monitoring. He will participate with computer monitoring, and inform them of any devices to which he has access and probation can install apps to monitor them. 

Probation can review his computer and phone and hard drives whenever they want, and they can copy any media and peripherals. He will have to report within 72 hours to probation. 

DC District has a return date next week at 1pm for Harding to appear via remote proceeding. Next Tuesday at 1pm is his DC District appearance.

Rep. Ilhan Omar (D-MN) refuses to back down from her criticism of the slain right-wing activist Charlie Kirk — and MAGA personalities have responded with fury.

After Kirk, the 31-year-old founder of Turning Point USA who was renowned for youth engagement and a number of controversial positions about race, religious freedom, and civil rights, was assassinated during an event at Utah Valley University in Orem, Omar criticized the media rush to whitewash his beliefs, saying on Zeteo News, "There is nothing more f----- up to completely pretend his words and actions have not been recorded and in existence for the last decade or so." She also reposted a comment calling Kirk a "stochastic terrorist."

The right-wing activist rage over Omar was further amplified after she was confronted by far-right Trump confidante Laura Loomer and an associate, ignoring their demands for an apology.

"Moments ago, @IlhanMN fled into her office after @LoomerUnleashed and @TheCharlesDowns asked her if she would apologize for resharing a video calling Charlie Kirk a 'terrorist' following his assassination by a radical leftist," Loomer posted on X. "Omar’s refusal to apologize for embracing political violence is a clear sign that she MUST be removed from her Congressional committees, and MUST be CENSURED immediately."

Many of the commenters cheered on the new push by Rep. Nancy Mace (R-SC) to censure Omar and strip her of committee assignments.

"Rep. Nancy Mace introduces a resolution on the House floor to remove Democrat Rep. Ilhan Omar from all of her Committee Assignments. This must pass!" wrote bodybuilder and MAGA commentator Ian Jaeger.

"Nancy Mace just officially filed a Resolution that will REMOVE Ilhan Omar from her committee assignments and censure her! EVERY LAST GOP REP. NEEDS TO BE ON BOARD!" wrote Texas-based MAGA activist "Gunther Eagleman."

"Ilhan Omar is officially in DANGER of being kicked off her committees and CENSURED for justifying Charlie Kirk's assassination," wrote right-wing internet personality Nick Sortor. "Rep. Nancy Mace just filed filed the resolution to make it happen. ALL REPUBLICANS SHOULD SUPPORT THIS! Somali Rep. Omar has ZERO BUSINESS having power over our country."

Big right-wing influencer appears in lawsuit against Trump’s ‘illegal’ firing



Federal prosecutor Maurene Comey, daughter of former FBI director James, has named right-wing influencer and so-called "Trump Whisperer" Laura Loomer in a lawsuit contesting her abrupt firing, for which "The Justice Department gave no reason," reports The New York Times.

Comey, who was working on cases involving Jeffrey Epstein, Ghislaine Maxwell, and Sean "Diddy" Combs when she was fired from the U.S. attorney's office for the Southern District of New York in July, "calls her firing ... illegal," the Times reports.

The lawsuit, in which Comey seeks her job, back pay and legal fees, names several defendants, including Attorney General Pam Bondi, the Office of the President and Loomer. Loomer called for Comey's firing via a successful social media campaign.

After Comey was let go, Loomer took a victory lap for what she deemed "a pressure campaign."

“This comes 2 months after my pressure campaign on Pam Blondi to fire Comey’s daughter and Comey’s son-in-law from the DOJ,” Loomer boasted in a X post, referring to Bondi.

On Monday, Will Sommer, senior reporter at The Bulwark, posted on X, "One NSC official stood between what appears to be a wildly corrupt deal involving the UAE, AI chips, and China. Then Laura Loomer intervened and got him fired. (She says it had nothing to do with the chip deal)."

“Laura is more trouble than she’s worth,” a White House official told The Free Press in July.

In the lawsuit, Comey said that the U.S. attorney, Jay Clayton, was unable to provide her with a reason for her termination.

“All I can say is it came from Washington,” Clayton told her, according to the lawsuit. “I can’t tell you anything else.”
