Higgins Welcomes Canada’s Action Postponing Penalties Associated with New Underused Housing Tax

Congressman Brian Higgins (NY-26) welcomed an announcement by the Government of Canada that it is postponing fines and interest associated with late-filed Underused Housing Tax (UHT) returns through October 31, 2023.

“This is a good development for the hundreds of residents from Western New York and across the United States who have been frustrated with the lack of notification and information and frightened that processing delays, which are no fault of their own, could result in steep penalties,” said Congressman Higgins, who serves as Co-Chair of the Northern Border Caucus. “Still, this is only a small reprieve in what amounts to a wrongful tax on good neighbors. We are continuing the fight to see the Underused Housing Tax eliminated entirely.”

The new 1% tax on “vacant or underused housing” owned by non-resident, non-Canadians is putting a financial strain on Americans, many of whom have contributed to Canada’s economy and owned cottages in Canada for generations.

Nearly 350 U.S. residents with property in Canada have completed an online survey objecting to the tax, and many more have called or written Congressman Higgins’ office. Of those who completed the survey, nearly 62% live in Western New York, but responses came from across the country including residents of Florida, Massachusetts, Ohio, and Connecticut, to name a few. Nearly 30 percent of responders have owned their Canadian property for over 50 years, with close to 40 percent owning their Canadian home between 20-49 years. 

The tax forms are due in Canada by April 30th, but owners must first file to receive a tax identifier number. In many cases, it takes weeks to receive the tax ID number impacting the ability to file in a timely manner. Failure to pay the tax comes with a penalty ranging between $5,000 and $10,000, plus interest.

Higgins has opposed the Underused Housing Tax since it was proposed in Canada’s Budget 2021. He continues to press the Biden Administration to address the tax in bilateral discussions. Higgins believes the tax violates the United States-Mexico-Canada Agreement (USMCA), has asked the United States Trade Representative to open up consultations related to the trade violation, and followed up that request most recently during dialogue with Ambassador Tai in a Ways and Means Committee hearing on March 24.

‘By hell, she’s impressive’: Kamala Harris gets thumbs up for energetic Wisconsin speech



Vice President Kamala Harris delivered a speech before an enthusiastic crowd in Milwaukee on Tuesday that earned plaudits from many progressive political observers — as well as relief about the contrast she delivers between herself and both President Joe Biden and former President Donald Trump.

Harris, who was endorsed by Biden on Sunday after he announced that he would be dropping out of the 2024 race, delivered a fiery address that touched on themes ranging from voting rights to reproductive freedoms to gun safety.

Writing on Twitter, many progressives took immediate note of the jolt of energy she had injected into the campaign.

"Elections are about all kinds of things, but I think a happy person talking about the future fits the moment better than an angry old man yelling about the past," argued Slate columnist Zachary Carter.

Watching Kamala Harris speaking in Wisconsin... By hell she’s impressive," wrote British broadcaster and media personality Carol Vorderman. "And she’s going to win … she’s energizing the young voters and has no fear of the fight."

NYU Law professor Chris Sprigman, meanwhile, praised Harris for delivering "a smiling, warm, positive affect, combined with coherent, declarative sentences in plain English."

"The election is going to be hard-fought," he added. "But God what a relief."

"So glad Harris is going with a future-focused message against Trump," commented Pod Save America host Tommy Vietor. "That's been missing to date imo. This is a Janet Jackson election: what have you done for me lately?"

Political reporters who watched the event also took notice of the new energy delivered by Harris.

"Hard to overstate how hyped the crowd is," wrote Politico Playbook's Eugene Daniels. "Very different vibe than usual."

"The contrast between Harris's speech and the speeches we've been hearing Biden give all year was striking," wrote New York Times reporter Peter Baker. "At none of the Biden speeches I've covered lately was the case made against the other side this sharply defined and delivered nor has there been this kind of energy."
