NIAGARA FALLS ATTORNEY PLEADS GUILTY FOR SEXUALLY ASSAULTING THREE VICTIMS

Erie County District Attorney John J. Flynn announces that 30-year-old Nicholas D. D’Angelo of Niagara Falls pleaded guilty this afternoon before State Supreme Court Justice Debra Givens to four counts of Sexual Abuse in the First Degree (Class “D” violent felonies), two counts of Criminal Sexual Act in the Third Degree and two counts of Rape in the Third Degree (Class “E” felonies). The defendant pleaded guilty to the charges ahead of a jury trial, which was scheduled to begin on May 8, 2023.

In the fall of 2016, the defendant met the first victim through an online dating website and picked her up at her residence for an arranged date. The defendant drove to an unknown location in the City of Niagara Falls where he forcibly engaged in sexual conduct with the victim inside of his parked vehicle.

On October 26, 2018, the defendant subjected a second victim to sexual contact by forcible compulsion at his law office in the City of Lockport.

Between August 2019 and October 2019, the defendant engaged in sexual conduct and sexual intercourse with a third victim on his boat at a marina in Niagara County. Between September 2019 and October 2019, the defendant engaged in sexual conduct and sexual intercourse with the same victim at inside of his vehicle in the City of Niagara Falls. At the time of both crimes, the defendant, being older than 21 years of age, engaged in sexual intercourse and sexual conduct with the victim who was less than 17-years-old.

The defendant was indicted by a Niagara County Grand Jury. The Erie County District Attorney’s Office was appointed as a special prosecutor after the Niagara County District Attorney’s Office recused
themselves from the case.

As part of the plea, D’Angelo agreed to surrender his license to practice law and will not re-apply for a law license in the future. He will be required to register as a sex offender.

D’Angelo is scheduled to be sentenced on Thursday, July 6, 2023 at 2:00 p.m. He remains released on his own recognizance with travel restrictions.

District Attorney Flynn commends retired Detective Brian Schell of the Niagara County Sheriff’s Office and the New York State Police for their work in these investigations.

The case was prosecuted by Chief Lynette M. Reda of the Special Victims/Domestic Violence Bureau and Assistant District Attorney Daniel J. Mattle of the Appeals Bureau.

A new filing in a defamation lawsuit filed by Georgia poll workers Ruby Freeman and Shaye Moss against the conspiracy theory website Gateway Pundit reveals that workers at the site feared for their credibility, reported The Guardian — and their own attorney warned them that the source for their claims was not to be trusted.

The site's founder, Jim Hoft, has earned the nickname "The Dumbest Man on the Internet" for years of strange and sloppy claims. Despite this, former President Donald Trump has been reported to be an avid reader of the site.

"Attorneys for Freeman and Moss ... said in their filing that John Burns, a lawyer for Gateway Pundit, had warned the site about relying on Kevin Moncla, a source in Georgia who fed the site information on Freeman and Moss, including their non-public personnel files, according to the filing," said the report.

"'Moncla is a known fabricator. I wouldn’t touch/publish anything he produces,” Burns reportedly wrote, while also calling Moncla “a g-------d fraud."

As if that weren't enough, Freeman and Moss’s attorneys also unearthed messages from Moncla said in which he said of their clients, "I will help you nail these b----s."

According to the report, Moncla was charged with voyeurism and ordered to pay $3.25 million after filming guests in the bathroom at his house.

Earlier this week, Gateway Pundit filed for bankruptcy amid the litigation against them.

Moss and Freeman, who counted ballots in Atlanta in 2020, have become a focus of numerous MAGA conspiracy theories, spread in part by Trump allies like Rudy Giuliani, who claimed that they were stuffing ballots — based in part on a supposed "flash drive" one passed to the other that turned out to be a ginger mint. Giuliani was found liable for $148 million in a defamation default judgment for his role in these claims.

In addition to the defamation cases, efforts to harass the two workers form part of the election racketeering case against Trump's allies in Fulton County.

‘Increasingly goofy’: Analyst hits Fox News’ for efforts to spin Trump trial



As Donald Trump's first criminal trial got underway, proceedings received extensive coverage in the media.

But over at Fox News, the story is not the center of the news world — and the network's focus was more centered around Trump's grievances over the trial, which accuses him of falsifying business records to cover up a hush money payment made to adult movie star Stormy Daniels.

According to The Daily Beast's Justin Baragona, "The rest of the cable news landscape has devoted round-the-clock coverage to the trial," but Fox has "mostly dipped in and out."

"Spending the bulk of its time on the pro-Palestinian protests at Ivy League schools, Fox News has centered a large portion of its Trump trial coverage on criticizing the case and the court’s treatment of the former president," Baragona wrote.

Baragona contends that Fox's approach to coverage of Trump's trial is causing its hosts and guests to take "increasingly goofy and zany positions" in order to defend Trump, and he cites a number of examples, including from The Five host Jesse Watters.

“The guy needs exercise. He’s usually golfing. And so, you’re going to put a man who’s almost 80, sitting in a room like this on his butt for all that time? It's not healthy,” Watters said during a segment this Monday.

“You know how big of a health nut I am. He needs sunlight and he needs activity. He needs to be walking around, he needs action. It’s really cruel and unusual punishment to make a man do that. And any time he moves, they threaten to throw him in prison!”

Baragona then points to the roundtable show Outnumbered, where GOP operative and regular Fox News guest Ian Prior compared Trump being criminally tried to the fall of Rome.

“The very problem that we have here is we are weaponizing the justice system to go after former presidents. You back up 2,000 years and this is the kind of thing they would do in the Roman Republic that led to the end of the Roman Republic,” Prior said. “Caesar is out there and says if you do not come back to Rome…and face prosecution, what did he do? He crossed the Rubicon and there’s the end of the Republic.”

Then there's Fox & Friends co-host Ainsley Earhardt, whose take on the matter didn't make much sense to Baragona, and he asked his readers to decide what the following commentary means.

“Does this set a precedent for other people who want to run for president?” Earhardt sighed. “What if they've done something like this in the past and they can say, 'Oh, well, they told me in the 8th grade they want to run for president, so since they paid off a girl when they were 30 years old, then that was election interference!'”

But the craziest take, according to Baragona, came from former Speaker of the House Newt Gingrich.

“I am deeply worried that tomorrow, a totally corrupt judge and a totally corrupt district attorney are going to try to put a former president of the United States, candidate of his party, and front-runner in the polls in jail. Now, I think this is so horrendous that there has to be some way to reach out to the Supreme Court,” Gingrich said on Monday night’s Hannity.

“This is literally like some of the civil rights workers in Mississippi in the 1960s. The New York system is now so deeply corrupted and it's so bitterly, deeply anti-Trump.”
